Image License Terms and Conditions

When you place an order with Fera Photography, you agree to abide by the following Terms and Conditions which are issued with each purchase.

IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS THEN PLEASE DO NOT PURCHASE THE DISC OR PRINTS.

Higher Resolution Disc

Fera Photography grants to you the non-exclusive, non-transferable, limited right and license to use the Images (the "Licensed Images") solely for the usage expressly authorized.  A licence will be issued with each disk.

License Usage and Restrictions:

This license is restrictive. Images may be printed by any commercial printer subject to these License conditions being adhered to.

Web Display:

Where the images are to be used on a web site for example on Social Networking websites such as Facebook, MySpace etc. Fera Photography requests that the client ONLY uses the low rez watermarked images supplied on the disk.  If Unwartermaked images  are used, Fera Photography will request that facebook etc removes them as breach of copywrite .   The reason for this restriction is to prevent unauthorised (by both Fera Photography and parents)  copies being made by third parties and use that may cause distress.

The watermark may not be cropped off the images.  Images are to be displayed / printed the way they are supplied, they may not be cropped or changed in any way.

Ownership:

All right, title and interest in and to the Images and the Licensed Images, including without limitation, all copyright, patent, trademark, rights of publicity and other proprietary rights, are owned and shall remain with Fera Photography.  These images may not be sold or given away to any third party.

Printing:

The images on the supplied disc are HIGHER RESOLUTION and may be printed by any home or commercial printer. No volume limitations are made and the images may be printed as many times as required.

Duplication:

The image disc may not be copied/duplicated in any format.

Termination And Jurisdiction:

This License Agreement is governed by English law and shall fall under the Exclusive Jurisdiction of the Courts of England and Wales. Any breach of this License Agreement will deem this agreement null and void.

Refunds:

Once the photographic shoot has taken place no refunds will be given.  If an appointment is cancelled less than two weeks in advance, a refund will only be given if the appointment is rebooked with another client.  Sitting fee is non refundable.

Print Images

Fera Photography grants to you the non-exclusive, non-transferable, limited right and license to use the Images (the "Licensed Images") solely for the usage expressly authorized.

License Usage and Restrictions:

This license is restrictive.  Licensed Images received in print format may under no circumstances be scanned or copied in any way or form.

Ownership:

All right, title and interest in and to the Images and the Licensed Images, including without limitation, all copyright, patent, trademark, rights of publicity and other proprietary rights, are owned and shall remain with Fera Photography.

If you would like digital copies of the images please contact us and we will supply a low resolution disk containing the images for web use.  (Postage costs apply)
